Eircom now own the colour orange. Perlico won’t blush red anytime soon for misleading advertising

Perlico get a rap on the knuckles for sending out flyers that were, shall we say, a bit devious? Personally, anything that takes customers away from Eircom has my vote, but standards are standards and they must be upheld :-)

In their judgement, they basically said orange belongs to Eircom. So there y’are. Complaining about Eircom gives them ownership of a colour as well as telephone lines. An unintended result.

The Complaints Committee considered the detail of the complaint and the advertisers’ response. The Committee noted that the colour orange was one of the five colours in the Perlico palette, and they were therefore entitled to use it in their advertising. However they also noted that the predominant colour in eircom’s advertising was orange. They considered that customers would associate the prominent use of the orange coloured background with eircom.
